7. Reliance on Information Posted
Content on the Website is provided for general informational purposes regarding stain removal and cleaning. Stain outcomes depend on many factors, including fabric type, dyes, finishes, age of the stain, and prior treatments. Always read and follow manufacturer care labels, test methods and products on a hidden area first, ventilate appropriately, and use protective gear when needed. We do not guarantee results, and you use any tips, methods, or product suggestions at your own risk.
We make no representations as to the accuracy, completeness, or usefulness of the information. Any reliance you place on such information is strictly at your own risk. The Website may include content from third parties; such opinions and statements are those of their authors alone and do not necessarily reflect the views of Stain Wiki.
8. Disclaimer of Warranties
Your use of the Website, its content, and any services or items obtained through the Website is at your sole risk. The Website is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. Without limiting the foregoing, Stain Wiki does not warrant that the Website will be accurate, complete, secure, reliable, error-free, uninterrupted, or that defects will be corrected.
To the fullest extent permitted by law, Stain Wiki disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow limitations on implied warranties, so these limitations may not apply to you.
Nothing in this section affects any warranties that cannot be excluded or limited under applicable law.
9. Limitation of Liability
To the maximum extent permitted by law, in no event will Stain Wiki, its affiliates, licensors, service providers, employees, agents, officers, or directors be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business interruption, arising out of or in connection with your use of or inability to use the Website or any linked sites or content, whether based in contract, tort (including negligence), strict liability, or otherwise, even if foreseeable. This includes, without limitation, damages resulting from cleaning or treatment methods described on the Website.
Nothing in this section limits liability that cannot be excluded or limited under applicable law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Stain Wiki, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, suppliers, successors, and assigns from and against all claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your violation of this Agreement or your use of the Website, including your User Contributions, your misuse of Website content, or your use of information obtained from the Website.
11. Governing Law and Jurisdiction
This Agreement and any dispute or claim relating to it or the Website (including non-contractual disputes or claims) are governed by the internal laws of the State of Michigan, without regard to conflict of laws principles.
Any dispute, controversy, or claim arising out of or relating to this Agreement or the Website will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its then-current Commercial Arbitration Rules, except as modified herein. Arbitration will be conducted in the State of Michigan or by video conference, at the arbitrator’s discretion.
The arbitrator has exclusive authority to resolve questions regarding the interpretation, applicability, enforceability, or formation of this Agreement. Judgment on the arbitrator’s award may be entered in any court having jurisdiction.
Each party will bear its own attorneys’ fees and costs and will share equally the arbitrator’s fees and administrative costs, unless the arbitrator decides otherwise. You agree to waive any right to a jury trial and to participate in a class, collective, or representative action.
12. Arbitration
At Stain Wiki’s sole option, any dispute arising from or relating to this Agreement or your use of the Website may be submitted to final and binding arbitration under the AAA’s rules applying Michigan law. This section is intended to be interpreted broadly to permit arbitration to the fullest extent permitted by law.
13. Limitation on Time to File Claims
Any cause of action or claim you may have arising out of or relating to this Agreement or the Website must be commenced within one (1) year after the claim accrues; otherwise, it is permanently barred.
14. Waiver and Severability
No waiver by Stain Wiki of any term or condition is a continuing waiver or a waiver of any other term or condition, and any failure to enforce a provision does not constitute a waiver. If any provision of this Agreement is held invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
15. Entire Agreement
This Agreement, together with our Privacy Policy and any additional policies posted on the Website, constitutes the entire agreement between you and Stain Wiki regarding the Website and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
